Welcome to ChatGPT Data DAO. These Terms of Use ("Terms"), along with our Privacy Policy, comprehensively govern your access to and use of our digital platforms, including the primary website and all associated services, tools, resources, and communities (collectively referred to as the "Sites"). These Terms are legally binding agreements between you (the user) and ChatGPT Data DAO, and by accessing, browsing, or otherwise using the Sites, you acknowledge that you have read, understood, and agree to be bound by these Terms.

By utilizing the Sites, engaging with our content, or by simply browsing the Sites, you affirmatively accept these Terms and agree to adhere to all conditions set forth herein. If you represent an entity, you confirm that you have the authority to bind that entity to these Terms. If you do not accept these Terms in their entirety, you must not access or use the Sites.

ChatGPT Data DAO operates on a model of collective governance. All members contribute to decision-making processes and adhere to governance principles as determined by the governance rules of the community. Your participation in ChatGPT Data DAO indicates your commitment to this governance model and the rules set forth thereby.

ChatGPT Data DAO operates on a blockchain network. Users should understand the following technical aspects:

• All blockchain transactions are permanent and cannot be reversed by technical means
• Users are solely responsible for the security of their private keys and credentials
• Smart contract interactions require network resources for processing
• The system operates on standard blockchain protocols and consensus mechanisms

Users should familiarize themselves with blockchain technology before interacting with the platform.

a. Data Export: You are responsible for lawfully exporting your ChatGPT data from your OpenAI account in accordance with OpenAI's terms of service.

b. Client-Side Encryption: All data you upload to the Platform is encrypted client-side in your browser using a key derived from your connected wallet's signature. We do not have access to your raw, unencrypted data.

c. TEE Processing: Your encrypted data is processed within a Trusted Execution Environment (TEE) to generate a "Proof of Contribution" and assess its quality. This process is designed to maintain the privacy of your raw data.

d. Data Ownership: You retain ownership of your raw ChatGPT data. By contributing, you grant the DAO a license to use the anonymized, aggregated insights derived from your encrypted data for research, model training, and other purposes as determined by DAO governance.

e. Prohibited Data: You agree not to upload any data that is illegal, infringing, or violates the rights of any third party, or contains sensitive personal information that you do not have consent to share (e.g., PII of others).

Contributions that are successfully validated by the TEE process may be eligible for rewards in the form of $GPT tokens (an VRC-20 token on the Vana Network). The amount of reward is determined by smart contracts based on the score assigned to your contribution by the TEE. All rewards are subject to the rules and availability defined by the DAO and its smart contracts. Token values are subject to market volatility.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information when you use our services.

We collect various types of data, including personal identification information, listening behavior data, and contribution data to support operations, enhance user experiences, and ensure the security of our platform. Our practices are guided by principles of lawfulness, fairness, transparency, and purpose limitation.

a. Information We Collect: We collect your wallet address and the encrypted data you submit. We may also collect usage data related to your interaction with our Platform.

b. Use of Information: Your wallet address is used to associate your contributions and distribute rewards. Encrypted data is processed in TEEs. Anonymized and aggregated insights may be used by the DAO as per its governance. We do not sell your raw personal data.

We implement robust security measures, including encryption and access controls, to safeguard personal information against unauthorized access and data breaches. All processing is done in secure TEE environments.

Data Security: We implement reasonable security measures to protect your information. However, no security system is impenetrable.

Data Retention: Encrypted data and associated metadata may be retained as necessary for the functioning of the DAO and its smart contracts. You can request information about your data by contacting us.

Users have rights to data access, correction, deletion, processing restriction, portability, and objection. Requests related to these rights should be directed to our established communication channels.

You are solely responsible for the security of your Vana-compatible wallet, private keys, and any passphrases or signatures used to interact with our Services. The DAO is not responsible for any loss of tokens or unauthorized access to your account due to your failure to secure your wallet.

The Platform, its underlying technology, and content (excluding user-contributed data) are the property of the ChatGPT Data DAO project or its licensors. You are granted a limited, non-exclusive, revocable license to access and use the Services for their intended purpose.

You agree not to:

• Use the Services for any illegal purpose or in violation of any local, state, national, or international law
• Attempt to circumvent any security measures of the Platform or TEEs
• Upload malicious software or data intended to disrupt the Services
• Manipulate the contribution process or attempt to unfairly gain rewards
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE CHATGPT DATA DAO, ITS DEVELOPERS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF REWARDS YOU HAVE RECEIVED THROUGH THE PLATFORM.

The ChatGPT Data DAO is intended to be governed by its token holders. Future governance mechanisms, voting rights, and proposal processes will be defined by the DAO community and implemented via smart contracts or other on-chain/off-chain mechanisms.

We reserve the right to modify these Terms or our Services at any time. If we make material changes, we will provide notice through the Platform or other means. Your continued use of the Services after such modifications constitutes your acceptance of the new Terms.

These Terms shall be governed by the laws of [Specify Jurisdiction, e.g., Switzerland, or state "the principles of decentralized governance as determined by the DAO token holders" if applicable].
